Pada Kamis, 5 Maret 2020
Jakarta, JBM.CO.ID | Dihadapan para seluruh pimpinan daerah, Menteri Koordinator Bidang Perekonomian Airlangga Hartarto kembali menegaskan bahwa RUU Cipta Kerja sejalan dengan prinsip desentralisasi dan otonomi daerah.
“Tidak ada satu pun pasal yang mengatakan resentralisasi. Hal yang kita dorong adalah perbaikan ekosistem perizinan, salah satunya dengan menerapkan Norma, Standar, Prosedur, dan Kriteria (NSPK) sehingga kita bisa bergerak lebih cepat, termasuk dalam hal mengantisipasi dinamika ekonomi global,” ujarnya dalam lokakarya Asosiasi Pemerintah Kota Seluruh Indonesia (Apeksi), Rabu (4/3).
Airlangga menjelaskan, kewenangan perizinan berusaha yang dilaksanakan oleh Menteri/Kepala Lembaga dan Pemerintah Daerah sesuai dengan UU Pemerintahan Daerah dan dilakukan berdasarkan NSPK. Penetapan NSPK mengacu atau mengadopsi praktik yang baik sesuai standar atau ketentuan yang berlaku secara internasional. NSPK ini ditetapkan dengan Peraturan Pemerintah.
“Selain itu, aspek lingkungan dan keamanan bangunan gedung pun tetap dijamin dalam RUU ini,” sambung Menko Airlangga.
Kemudian, mengenai pendapatan daerah yang berasal dari Pajak Daerah dan Retribusi Daerah (PDRD), tidak akan mengalami penurunan. RUU Cipta Kerja tidak menghapus PDRD sehingga daerah tetap dapat mengenakan PDRD sesuai ketentuan.
“Bahkan dengan mendorong perizinan berusaha yang terintegrasi secara elektronik, maka Pemda akan memiliki basis data terkait dengan perizinan berusaha yang wajib dimiliki oleh pelaku usaha sehingga lebih dapat mengoptimalkan potensi pendapatan yang ada,” terang Airlangga.
Menko Perekonomian pun menjelaskan, Kementerian Dalam Negeri saat ini sedang menginventarisasi berbagai Perda yang perlu direvisi dalam rangka pelaksanaan UU Cipta Kerja serta Perda yang dipandang menghambat pengembangan investasi dan pencipataan kerja di daerah.
Satu hal yang juga Ia garisbawahi, RUU Cipta Kerja mengubah konsep perizinan berusaha yang semula berbasis izin (license approach) ke konsep perizinan berbasis risiko (risk based approach). Hal ini dimaksudkan untuk menyederhanakan perizinan berusaha di Indonesia dan masuk ke konsep penerapan standar.
“Prinsip utama dalam penerapan konsep Perizinan Berbasis Risiko adalah Trust but Verify, artinya untuk kegiatan yang bersifat rendah dan menengah tidak diperlukan izin, sebagai bentuk persetujuan Pemerintah untuk melakukan usaha tersebut,” kata Menko Airlangga.
Pemerintah, lanjut Airlangga, memberikan kepercayaan kepada pelaku usaha untuk melakukan kegiatan usaha sesuai standar yang telah ditetapkan Pemerintah, namun Pemerintah tetap mempunyai kewenangan untuk melakukan verifikasi (inspeksi) atas penyelenggaraan kegiatan usaha tersebut.
Adapun tujuan utama dari adanya RUU Cipta Kerja adalah terciptanya peluang usaha untuk pertumbuhan ekonomi yang berkualitas melalui kemudahan dan simplikasi perizinan, pemberdayaan UMK-M dan koperasi, serta penciptaan lapangan kerja dan kesejahteraan pekerja yang berkelanjutan.
“Sasaran jangka panjangnya adalah untuk mewujudkan visi Indonesia 2045 yaitu menjadi 5 besar kekuatan ekonomi dunia dan bisa keluar dari Jebakan Negara Berpendapatan Menengah,” tegas Menko Airlangga.
RUU Cipta Kerja ini akan dibahas dan diharmonisasikan oleh DPR. Masukan dan penyempurnaan rumusan akan dimuat dalam Daftar Inventarisasi Masalah (DIM) yang disusun DPR. Untuk itu, DPR dapat mengundang masyarakat dan pemangku kepentingan dalam pembahasan DIM dimaksud sesuai dengan mekanisme yang ada.
“Pemerintah berdasarkan aspirasi masyarakat dan pemangku kepentingan tetap dapat menyampaikan tambahan penjelasan untuk penyempurnaan rumusan RUU Cipta Kerja dalam pembahasan di DPR,” pungkas Airlangga. /JBM
